A few weeks ago I was at a vineyard looking at some equipment that can be used with netting. After taking up two hours of the growers time we decided to head up to the tasting room and enjoy a little fruit of the labor. I had a couple of people with me who were from the Eastern part of the country and hadnt had a chance to taste some of the California wines, so they were more than happy to spend some time tasting, and buying, as it turned out. While we were working I had noticed a couple of other vehicles passing through, headed toward the tasting room as well. Once we entered, our host was immediately recognized. The first question out of everyones mouth was, What were you doing out there? When bird control was the answer, I could tell from the look on the faces present that we were in for a show. The next five to ten minutes were spent covering everything from propane cannons to netting to chemicals. The amount of misinformation was amazing. These people clearly felt that anything that had to do with bird control was a complete waste of time, irritating to look at and listen to. Why? Well because, those birds cant possibly be that damaging to your wine-grapes - theyre just little birds after all.When you have enough experiences like this you begin to get a feel for the public perception regarding animal damage control. As a grower or winemaker you are involved so heavily in the industry that some things are taken for granted. Everyone realizes that gophers, ground squirrels, starlings and finches are vineyard pests who damage grapes - right? Wrong. A very large percentage of your customers, lets say 75% conservatively, do not think you have any sort of problems with wildlife.What do you think of when you see a deer, or a covey of quail, or some cottontail rabbits in your vineyard? I can guarantee that the terms, Oh, how cute, or Hey, look at those deer dont usually come to mind. I cant print what usually comes to mind for most growers. However, for the people that we encountered in the aforementioned tasting room, as well as for a large percentage of your customer base, seeing wildlife is all part of the vineyard experience.
Rodent control is taking some interesting and not so encouraging turns. There is an initiative that will be introduced in California on the November 1998 ballot (assuming it gets the 500,000 signatures needed, which is a slam dunk in California). It is called an Initiative to Ban Cruel Traps. This initiative, in a nutshell, will make it illegal to use a body gripping trap. one that grips the mammals body or body part, including, but not limited to, steel-jawed leghold traps, padded-jaw leghold traps, Conibear traps, and snares. This initiative also states that, it is illegal for any person, including employees of the federal, state, county or municipal government, to use or authorize the use of any steel-jawed leghold trap, padded or otherwise, to capture any game mammal, fur-bearing mammal, non-game mammal, protected mammal, or any dog or cat.Now, stop and reread that paragraph and think about it for a minute. This initiative decides for us that we cant control agricultural fur-bearing pests any longer. For that matter, it specifically states that you cant trap anything that has fur on it for any reason, and that the U.S. Fish Wildlife Service, State Department of Fish Game and your local county ag commissioner or county trapper cant do it either. It does make provision for the protection of human health and safety (pretty considerate - you know how vicious those gopher and mole attacks on children have been lately), and it will allow you to use mouse traps in your basement. Oh, and by the way, it introduces two chemicals that can no longer by used - Compound 1080 and sodium cyanide. What are these used for? Well, its not rodent control. The state has been experimenting with these two chemicals for coyote control. They make a collar to put around a lambs neck. If the animal is unfortunate enough to be a victim of a coyote attack and the coyote punctures the collar its lights out for the sheep killer. The point here is precedent - get these two and then work your way on to household chemicals for insect and rodent control and sweep everything up in between.Since this is not a political editorial, all I can say is watch out for this one. Agriculture will lose big time, so tell a friend and lets make sure that we dont get tied down by bad law written by extremists. I think it is very important that we dont make our decision based on whats on TV. Hollywood is anti-trapping and they have a lot of money to spend to support their position. If you want a recent case history lesson you may look at the fine State of Colorado, which had a similar initiative pass last year by a 51% margin. After the smoke cleared, it was disclosed that Hollywood spent just a little over a quarter million dollars to promote the initiative. All the local state and county representatives, combined with the agriculture and fur trapping industries, could muster was $48,000, and they lost.

MONEY MART LOAN SHARK *A report on abusive lending practices, released in November 2004, put the spotlight on Money Mart, one of an estimated 1,200 payday lenders across the country. The effective annual interest rates of these outfits range between 300 and 900 per cent, but, in the case of Money Mart, they go as high as 1,000 per cent. Yes, thats 1,000 percent. Its a $1-billion-a-year business, and virtually unregulated. The report was released simultaneously in British Columbia and Ontario. ACORN has called on the governments of both provinces to enforce the Criminal Code (SEC. 347), which outlaws rates higher than 60 per cent. They have also called on the provincial governments to implement a comprehensive regulatory system governing the industry, to protect Canadians from predatory lending practices. SCARY but true: it is now possible to borrow pounds 25,000 over the phone. If you are considered a good credit risk, Direct Line and Coutts offer pounds 25,000 loans. The move comes after a change to the Consumer Credit Act 1974, which previously limited borrowers to pounds 15,000. So if you are planning to buy that BMW this August, there are alternatives to the car dealers finance. You can borrow from as little as pounds 300. And if you want the money urgently, you can get a decision from some lenders within a few hours, depending upon the amount you want to borrow. If you are borrowing a large amount, lenders have to be confident that you can pay the money back. “We check customers details very carefully,” said Lydia Young, of Direct Line. “We can agree a loan in principle over the phone, but we then ask a customer to fill in an application form and submit salary slips before we can give a firm agreement. But we can usually agree a loan within a few days.” Unsecured personal loans are usually available to anyone who can satisfy the lender that he or she is a good credit risk. If you are in regular employment and have lived at your present address for more than three years you stand a good chance of been given a loan. Repayment terms vary between six months and 10 years. The longer the term, the more you will pay back. So try to pay back as much as you can, without stretching yourself too much. As a rule, dont set aside more than 10 per cent of your takehome pay in loan repayments. Some lenders will allow you to take a payment holiday of two or three months and others, such as Sainsbury, allow you to defer your repayments. This could be useful if you know your finances are going to be stretched in the short term. But lenders offering payment holidays tend to be among the most expensive. The amount you repay will depend on the amount you borrow, the repayment term and annual percentage rate (APR). You can also opt to take payment protection. This guarantees your loan repayments if you are unable to pay because of illness, injury or unemployment, but it will increase the cost of your loan considerably. Try to avoid this if you are in a steady job: it puts about pounds 20 a month on every payment on a pounds 5,000 loan. Watch out for the small print: Birmingham Midshires, Co-operative Bank, First Direct, Marks Spencer and Northern Rock charge a higher APR if you do not agree to take out insurance. There may be other costs that arent included in the repayment tables. Capital Bank, for example, charges an pounds 85 loan arrangement fee, and Royal Bank of Scotland charges a fee of 1 per cent with a minimum of pounds 25 and a maximum of pounds 60. Most lenders want you to repay your loan monthly by direct debit. And you can pay the loan off in full before the end of the term, but you will usually be charged a penalty of one or two months interest. If you think you can pay off the loan with a lump sum, such as a bonus from work, look for a loan that does not charge a penalty. Most lenders provide leaflets with a breakdown of costs. Each lender should quote an APR. This is the cost of borrowing, based on the interest rate, fees and other administrative costs. But lenders do calculate APRs in different ways so they can be difficult to compare directly. Your existing bank or building society may give you preferential rates, but dont automatically let it lend you the money. It makes sense to get a few quotes. Always look at the total cost of borrowing, not just the APR. The personal finance pages of weekend papers carry details of the cheapest rates. If you want to borrow a small sum of money over a short period of time, you may have problems. Only a handful of lenders will lend as little as pounds 500 and the minimum repayment can be six months, but more usually a year. Taking out an overdraft or borrowing on a cheap credit card can be a cheaper and more flexible way of borrowing in the short term. Monday May 5, 2003 will go down in history as a day to remember in employment law. It was the day the long-debated amendments to the Health Safety in Employment Act finally came into effect. Why is this new legislation so important? The term “workplace stress” took on a whole new significance, with new obligations for employers, and potentially serious financial consequences for those who ignore them. Workplace stress is no longer simply a sad fact of life. It is now an officially recognised and legislated “workplace hazard”, with the amendments extending the definitions of “harm” and “hazard” to include physical and mental harm caused by work-related stress. A cursory reading of the new legislation might be enough to instantly treble employers workplace stress, but a deeper understanding goes some way to restoring mental equilibrium. The Occupational Safety and Health booklet, Healthy work, Managing Stress in the Workplace, tells employers that “there is only a requirement to manage work stressors or the individuals stressed situation where you can be reasonably expected to know about the stress. Even then the obligation is only to do what is reasonably practicable in the circumstances.”

Why wait for the polypill when you can make a real difference to your heart health, starting today. The research reported in this issue is generally focused in two areas. First, several authors look at the role of publicly traded real estate securities in portfolio management for investors in direct real estate equities. Simon Stevenson, in The Long Term Advantages to Incorporating Indirect Securities in Direct Real Estate Portfolios examines the impact of REIT investment in both an optimal and a more probable world. His findings are interesting because they show that REITs bring improved performance to portfolios that look more like the NCREIF portfolio while their marginal value to an optimized direct portfolio may not be evident. The other interesting finding is a significant performance improvement brought by the addition of multi-national property securities to a domestic direct portfolio. Should investors approach an asset class in the context of their portfolio goals? Timothy Craft explores that issue in The Role of Private and Public Real Estate in Pension Plan Portfolio Allocation Choices. He examines the portfolio allocation choice in the context of a plans pension liabilities. One interesting result is a resolution of the dichotomy between standard optimization models that often argue for high real estate allocations and the typically lower allocations found in existing plan portfolios. Michael Seiler, James Webb and Neil Myer test the expectation that private real estate portfolios can be adjusted with real estate securities in Can Private Real Estate Portfolios Be Rebalanced/Diversified Using Equity REIT Shares? They conclude that REITs are a worthwhile addition to mixedasset portfolios but that they do not bring the ability to effectively rebalance or create marketneutral portfolios.

Then narrow wins over Japan and Fiji got Scotland through the group stage but there was a record defeat to France before the inevitable exit at the hands of Australia. In July 1993, a pretested questionnaire and a letter describing the purpose of the study were mailed to all dentists employed by IHS (n=389) and FBoP (n=120). IHS dentists provide clinical services in 200 dental clinics in IHS/tribal hospitals or ambulatory health centers in 33 states. Within the FBoP, inmates receive dental treatment at 107 dental clinics. Of the 509 dentists who were mailed the questionnaire, 489 (96% [372 IHS and 117 FBoP]) responded. Of the 489, 194 (40%) dentists had practiced clinical dentistry in the IHS or FBoP for lt;3 years; 183 (37%), 3-9 years; and 112 (23%), [equal to or greater than] 10 years. The mean years of clinical practice were similar for dentists in both groups (5.9 years for IHS and 5,6 years for FBoP dentists; p=0.7, two-tailed t-test); 438 (90%) reported that they were practicing clinical dentistry at the time of the survey (87% IHS and 97% FBoP), and the remainder were in nonclinical positions. Almost all (474 [97%]) respondents reported ever having received a TST (365 [98%] IHS and 109 [93%] FBoP); 92% of those tested reported always having a negative test result (Table 1). Of 36 dentists who reported ever having a reactive TST, 17 (47%) reported the first reactive TST occurred after graduation from dental school. Of these 17 dentists, 14 (11 IHS and three FBoP) reported converting from a negative TST to a reactive TST.
IT should come as no surprise that some National Health Service dentists are threatening to quit over government reforms in dental care. They will still rake in plenty of cash, but its not enough for some greedy dentists whose surgeries are more crowded than Ken Dodds mouth.

(This article originally ran in Lawyers Weekly USA, Boston, MA, another Dolan Media publication.) When parents with children divorce, their relationship is rarely over. The plan - which was distributed in September to 1,600 members - is intended to be a road map for navigating potentially bumpy child- rearing issues. It covers everything from where children will live and who theyll spend holidays with, to what after-school activities they can attend and what their summer schedules will be. The plan also asks parents to agree on their childrens religious upbringing and to confer with each other about non-emergency medical, dental and psychological treatments.
Divorce doesnt have to be as antagonistic and expensive as it often is or take as long as it usually does, say some area divorce lawyers who are offering an alternative way to end a marriage. In the “collaborative-law” process, both husband and wife meet together with their lawyers to reach a settlement, which is then brought before a court for final approval. Lawyers, who have settled divorces using this method, say the process is shorter compared with traditional divorce litigation, and, therefore, less costly.
THE POPE has urged Roman Catholic lawyers and magistrates to refuse to handle divorce cases. He warned that divorce was “spreading like the plague” and lawyers should decline to use their profession for, “an end that is contrary to justice”. Pope John Paul II has in the past insisted that Catholic doctors not perform abortions or assist women with contraception. But this is the first time he has tried to tell the legal profession what to do. The reaction from politicians and advocates in Italy has been one of dismay at such open interference in civil issues.

The program was started a few years ago. Safeco was interested in getting into the medical malpractice market and saw podiatry as a good market. As Doman explains, “Podiatrists have been treated by many malpractice carriers as outside the traditional medical professions. Yet they have an equivalent type of education. They get a DPM (Doctor of Podiatric Medicine) after college and are board certified.” Safeco was approached by an agent who had a program, so they put together a product. Question: I am a podiatrist, and I would like to comment on toenail fungus and treatment. When you write “Home remedies dont always work,” you imply that sometimes they do work. This is untrue. Home remedies rarely work. There are real, doctor-prescribed, FDA-approved, clinically tested medications to treat toenail fungus. These include topical Penlac or oral Lamisil or Sporanox. I have successfully treated hundreds of patients with these drugs. Answer: We know that home remedies like Vicks VapoRub dont always work. But we have heard from many individuals who responded well to dilute vinegar soaks or topical applications of Vicks or tea tree oil to their infected nails. Significant ethical risks prohibit criminal defense lawyers from arranging or posting bond for clients in all but the rarest of cases, but there may be tactical reasons for them to do so and circumstances where they may. But the committee also suggested that it would be rare to obtain genuine and voluntary informed consent from a client experiencing stress, anxiety and other pressures from confinement and the conditions of incarceration. The committee noted that civil rights lawyers historically posted bond for criminal defendants where it was likely that no one else would do so. It acknowledged that obtaining the release of a client from custody could be a practical or tactical goal in handling a criminal case, which could qualify the step as a legitimate cost of litigation. It also suggested there might be occasions in which a lawyer who is a friend of the clients family would reasonably expect the family to indemnify her for any loss.

As expected with confidence remaining volatile over the last few months and only rising slightly in June, retail sales have been patchy, rising by just 0.4% in Q1 after being flat in Q4. We expect a further weakening in retail sales growth, in line with our forecast for an overall weakening in household expenditure in H2 2006. * The trade deficit widened yet again in April to EUR 6.88bn, a 5.5% rise on the year, after already reaching 8.9% of GDP in Q1. While this figure is necessarily high given recent developments in oil prices, it also does hint at underlying structural problems. If youve a mind to show off, then you do so in the best of company with Bartoks Concerto for Orchestra. Characteristically, though, Gattis Bartok is more about drama than display. And thats more of a novelty than you might think. Bartok so often gets left behind in performances of the Concerto. So often its about sound not because of sound. So often the music is subsumed by the special effects. The shows the thing. Not here. Gattis “Introduzione” at once opens magic casements on to the concerto beyond. Muted string tremolandi are drawn like a veil over the opening pages, the violas sul ponticello adding a touch of frost. The solo flute is pale and very interesting. Not a bar, not a note goes by that doesnt convey something. The intrigue of a first encounter, thats the spirit. So those little oboe and/or clarinet and harp diversions in the first movement come on like ancient airs and dances; so there is nothing remotely faceless about the woodwind “couplets” of the second movement; so the third movement “Elegia” stretches and intensifies the dynamic possibilities, suggesting a lake of tears to shame even Bluebeard, with ardent violins pulling more sound up from their bottom strings than Ill wager even they thought they had. When did you last hear the cor anglaiss plangent canon to the lyric main theme of the “Intermezzo interotto” sound this purposeful? And since when did Till Eulenspiegel get to play tag with the Shostakovich “Leningrad” theme? All right, so the finale sacrifices fire to the rustico character of the music (presto? hardly), so youre listening to the Royal Philharmonic thinking of the Chicago Symphony. But theres more music being made here than in the average Concerto for Orchestra - and thats a fact. The Divertimento, meanwhile, is further testament to Gattis work in progress with the RPO strings. Folk dance and fiddling are at the heart of this piece, the character once again dictating the sound. Which is just as it should be and so rarely is. Edward Seckerson

Swathed from top to toe in bandages, a young woman looks up at the sky. True to her prediction, the plane she is waiting to observe crashes shortly after take-off, killing 127 people. The boyfriend accused of causing her dreadful burns should have been on that flight, but his remains cant be found in the wreckage. Instead, the play discovers him in the middle of the desert in the company of a figure wearing an identical suit. The missing mans skin is baked. He has lost all sense of identity. What, this drama asks, would it be like to go through a gradual dream-like process of rediscovering the horror of who you were and to realise that, through the fluke of survival, you have been punished by not being punished? A metaphysical mystery story; an existential memory play; a psychological study of blank indifference; a pitch-black jest - Tear From A Glass Eye manages, beguilingly, to be all of these things and in Erica Whymans splendid production at The Gate, these various elements achieve a brilliant artistic unity. Runway lights flash forebodingly along Soutra Gilmores zig-zag wing-like set, which has just the right denuded, abstract feel and pointedly offers no hiding place for Ian Drysdales terminally perplexed Titus, who is drawn back into his past by an enigmatic alter ego (Darrell DSilva). The mixed tone of the play suggests that life is both an ineffable nightmare and a down-to-earth practical joke. The drama is haunted by the eponymous symbol whose significance we learn from flashbacks. Returning from the War, Tituss amputated father (a superbly anarchic James Hayes) tries, counterproductively, to rush intimacy with his young son. As a curiosity, he gives the boy a glass eye he found next to a dead body in the desert. Made of sand, this object, with its changeless unconcerned stare, comes to represent a different kind of desert - that state of emotional indifference which is Tituss hell. It is a poetic image of which the young T.S. Eliot might not have been ashamed.

LAWYERS who had wanted General Pinochet extradited were still trying early last week to decide what “legal steps” they could take to stop him going to Chile. For some reason I found myself thinking of the sad advertisements one used to see occasionally in the personal columns: “Public school man seeks interesting job, anything legal considered.” But of course I was confusing two different functions of the word legal. Ethical began by meaning “to do with ethics”, and only later came to mean being good. The purist in me still winces when someone says “aesthetic” when they mean “in good taste”. (Aesthetic originally meant “to do with the science of perception”, then “to do with taste”, good, bad or indifferent.) But there was never any need for legal to carry two meanings, because theres a perfectly good alternative that takes half the burden off it: lawful, a nice old word from the late Middle Ages (its parent word, law, appears to be of ancient Scandinavian origin). Everyone understands the difference between “legal business” and the “lawful business” that most of us spend our lives going about. Why couldnt those job-seekers have put “anything lawful considered”? Lawyers use lawful, too; they speak of a “lawful killing”. They dont say “a legal killing” (which, if it meant anything, would presumably refer to their fees).

Data for June and July show the first signs of softening in the construction sector. According to seasonally adjusted data, the value of construction put in place in July was approximately at the same level as in June and thus 7.4% lower than in May. In the five months to May, the value of construction put in place was 38.7% higher than a year ago; in June and July the difference narrowed to 16.7%. Employment in the construction sector continued to rise. In 2006, the number of workers employed in the construction sector was 7.5% higher than in the previous year. In the first seven months of 2007 it surged by 11%. The hiring of foreign workers has also been on the increase (see SEM 7/2007: 11). The number of workers rose particularly in building completion and general construction, similarly as last year. In terms of worker status, sole proprietors and their employees recorded higher growth rates. Increasingly many firms face difficulties in finding labour. According to business trends in construction, 51% of construction firms reported “a shortage of skilled labour” as a limiting factor to production. If answers are weighted by the number of employees, this share is even higher (58%) - the highest in five years (since these data have been available). The shortage of skilled workers became a significant limiting factor in the second half of 2006 (see graph), coinciding with the boom in construction activity in that period.
After the robust growth in 2006, construction activity posted even higher growth rates in 2007. The value of construction put in place surged by 18.5% over 2006. Activity in civil engineering increased by 24.7% as a result of the construction of transport infrastructure. The construction of buildings grew by 15.5%; within that, non-residential construction was up 20.2%, whereas activity in residential construction decreased by 0.9%. Based on detailed data on issued building permits, the vigorous construction of hotels appears to have continued last year, probably along with the construction of wholesale and retail trade buildings. In interpreting the figure on the value of residential construction put in place we should bear in mind that these figures exclude the activity of smaller firms (see the note under the table), where the construction of buildings is the main activity. Stronger growth was partly linked to favourable weather conditions, especially in the first half of the year. This is corroborated by the business trends regarding the limiting factors in construction. The share of firms that reported bad weather conditions as a limiting factor was much lower in the first half of 2007 than in the previous year. The weather was also more propitious than the year before in the third quarter, but it was less favourable in the fourth quarter, which affected growth in the latter part of the year. The growth in the number of employees increased further last year. In 2007 the number of people employed in the construction sector was 11.3% higher, on average, than in 2006. The number of workers by activity rose particularly in building completion; in the latter part of the year it also increased in general construction. In terms of employee status, higher growth rates were recorded in the number of sole proprietors and their employees.

The Profession Has Changed, but What About the Professionals? With all this running, are we really getting anywhere? Poet Henry David Thoreau said: “The unexamined life is not worth living.” Today, who has time to examine anything? For most responding to the study, salaries have increased only about 3.5 percent per year over the past 20 (from U.S. $24, 876 in 1980 to $46,000 today). Budgets are up from $250,000 to $300,000, representing about a 1 percent annual hike. While investments in technology have helped increase productivity and keep costs down, increases in salary have barely kept up with inflation rates and budget increases clearly havent even done that. And, for having larger staffs to help with the increased emphasis the communication function reportedly enjoys today, communication staffs have actually shrunk since 1980. Industry research confirms key search marketing challenges; WebTrends Dynamic Search customers prove opportunity for automated optimization According to JupiterResearch, the vast majority of marketers will increase paid search spending in 2007, yet more than 60 percent of advertisers said rising keyword prices are a problem. In addition, 45 percent of advertisers said they had trouble tracking the effectiveness of search marketing, and 43 percent indicated problems managing search across multiple engines and discovering new effective keywords. As keyword prices rise, smart advertisers must find relatively cheaper keywords..developing a long list of keywords for testing will become necessary (JupiterResearch, US SEM Executive Survey, 2007). The majority of respondents to the WebTrends survey are running 10,000 or fewer keywords in their paid search campaign, including 22 percent saying they run 1,000 to 10,000 keywords and 31 percent stating they use 1-1,000 keywords. Of all respondents, however, 21 percent indicated they are running over 10,000 to more than 200,000 keywords.
Board members, especially those serving on audit committees, have taken on new risks and responsibilities. Now theyre getting paid more, too. Thats the conclusion of a recent survey by Sibson Consulting. Of the 69 companies that took part in the survey, about two-thirds are either making or planning material changes to their directors compensation by upping per-meeting fees and retainers and altering the cash and equity mix for their directors. And where committee service is involved, all of the companies planning to make changes to committee pay say they plan to increase compensation for audit-committee service. “Everybody has been reevaluating,” says Susan Shultz, president of Phoenix-based SSA Executive Search International Ltd., as well as the author of The Board Book (Amacom, 2000). “Sizable companies now see that directors are worth more money.” Thats because theyre doing more work. Shultz estimates that committed board members currently work an average of 300 hours a year for each board they sit on. And, she says, they are taking a more strategic role in the company.

Recent legislative changes in Albertas child welfare laws should bring good news to children and families in need of child-centered services in the province. The Family Support for Children with Disabilities Act is primarily a reimbursement program assisting with some of the extraordinary costs of raising a disabled child and providing a range of services to assist families with disabled children. In addition, new initiatives, such as a province-wide toll-free telephone line to link families to child disability information, promote the ready access to and exchange of information for these families. Family-focused supports are designed to strengthen a familys ability to care for a disabled child, both before and after diagnosis. Child-focused services are provided once a child has a confirmed diagnosis and a specific assessment of his or her own particular needs, which may include respite services, aide supports, child care, health-related supports, specialized services for children with severe disabilities and/or out-of-home living arrangements. The Child, Youth and Family Enhancement Act (the Act) brings in a number of changes to the old child welfare system, placing greater emphasis on the safety and well-being of children as well as on family participation in decision-making with Childrens Services. One of the most significant changes in this area of the law has to do with permanency planning for children in need of intervention. Under the new Act, the cumulative time in care timelines have been shortened and varied based on the childs age. For example, the cumulative time in government care for children under the age of six has been changed to a maximum of 15 months, with 18 months for those over the age of six.

How does it work? Lets compare it with a typical scenario. Mom and Dad are getting a divorce, and they cant agree on anything. Each of them goes to a lawyer to find out what their rights and obligations are. First, the lawyers explain the law, and then send them to mediation to see what they can settle. Mediation is unsuccessful, and the parents go back to the lawyers. Second, the lawyers try negotiating between themselves, but still cant resolve the issues. So, the lawyers launch into the third stage — the litigation process. They hold examinations for discovery and may bring interim court applications. Both sides may hire experts to support their positions. They line up the witnesses, and everyone heads down to the courthouse. There, a judge hears about the family for a few hours or a few days, and makes a decision everyone has to live with for the rest of their lives. The litigation process is expensive, time-consuming, and emotionally draining, with no guarantee that either party will be happy with the outcome. In CFL, the process stops short of the litigation stage — both parties and their lawyers sign a written contract confirming that none of them will go to court under any circumstances. They must negotiate their own settlement. Instead of using their resources to do battle against one another, they jointly hire a team of experts to help them solve their problems. Mom and Dad may meet with a therapist to help them put aside the emotional issues of the divorce. The therapist may work on improving their communication skills so that meetings are more productive. Mom and Dad may also hire a child specialist to identify their childrens needs, and help them build a parenting plan that meets those needs. Mom and Dad both agree to make full financial disclosure, and they may hire a financial planner to help them sort out the dollars and cents of their divorce. The financial planner might present budget alternatives, or present a range of financial planning alternatives. All these experts are neutral third parties and do not favour one side over the other. The lawyers serve several functions in the CFL process. They must make sure each client sticks to the contract and negotiates in good faith. For example, if one learns that his/her client is withholding information, he or she must advise the other side that the process is at an end (to preserve solicitor-client privilege, they reveal no details of the problem). The lawyers also supervise the process, and coordinate the joint hiring of the third party experts. They set the agenda for the four-way meetings with the other party. They familiarize themselves with their own clients needs and fears, and give him or her independent legal advice. When the process is successful, they write up the terms of the negotiated settlement.

The most recent USDA dietary surveys report that about half of women in childbearing years have iron intakes below the mean requirements and some 95% have intakes below the RDA. (1) In another study, the majority of the women surveyed did not achieve 70% of the RDA for iron, putting them at strong risk for deficiency. (2) Albion Laboratories makes an iron that is safe, bioavailable and a true chelate, Ferrochel[R]. Chelated minerals are minerals such as zinc, manganese, magnesium, copper, iron or calcium that are bonded to amino acids. In the bodys natural digestion process, amino acids chelate with minerals and help transport them across the intestinal wall, making the mineral bioavailable. Since Ferrochel is composed of iron and the amino acid glycine, Albion refers to it as a nutritionally functional mineral chelate. Irons role in hemoglobin formation is well known; glycines importance in the process is less familiar. Glycine and succinyl CoA are the starting materials for hemoglobin. Albion Laboratories contends that the other half of the Ferrochel chelate–glycine–is just as important in creating a nutritionally functional product.
Stephen Barrett, MD, board chair of Quackwatch Inc., applauded the FTCs action. The government agency, which oversees the advertising of nonprescription drags, has taken an aggressive stance on the claims made by health products in the last two years. He said the agency has filed more false advertising claims in the last two years than during the 1980s. The FTC issued 1,200 warnings after an international health claim Internet surf day Nov. 10, 1998 when numerous agencies surfed the Internet and assessed Web sites. Email the FTC at health-claims@ftc.gov to send complaints or comments about health claims on the Internet. Chelators added to pectinase-rich enzyme mixtures increase the efficiency of enzyme retting of flax. The multitude of available chelators requires research to optimize enzyme retting for cost and fiber quality. Of several chelators tested, ethylenediaminetetraacetic acid (EDTA) is the most effective in sequestering calcium from solution, with substantial activity even at pH 4 or 5. Phosphate is also effective, but only at high pH. EDTA and Mayoquest 200, a commercial product with -37% EDTA, in combination with Viscozyme L or Lyvelin, commercial enzymes with polygalacturonase activities, yield high Fried test scores, indicating efficient separation of fibers from core tissues. Neither chelator nor enzyme at the levels tested alone effectively rets flax at a pH of around 5. In contrast, EDTA at 20 mmol/L levels and alkaline pH yields high Fried test scores. The addition of BioPrep, a commercial pectate lyase, does not influence retting measured by the Fried test with EDTA at alkaline pH, but the enzyme does improve retting with the weaker chelator sodium tripolyphosphate. The quality of fibers, as determined by the yield of fine fibers obtained by passing retted flax through the Shirley analyzer, is substantially greater with EDTA plus Viscozyme at pH 5 than alkaline chemical retting with EDTA, sodium tripolyphosphate, or sodium oxalate without enzyme. EDTA is the most effective chelator at acidic pH levels for stimulating flax retting by various commercial pectinase-rich enzyme mixtures. However, other less expensive candidates require additional study for more cost-effective formulations and applicable fiber properties. Retting is the process by which fibers in flax (Linum usitatissimum L.) stems and other bast plants are separated from the nonfiber tissues. This process, which is usually microbial, is the major limitation in producing linen fibers [25]. For commercial flax fiber operations, flax stems are pulled from the ground and dew retted, in which indigenous fungi colonize and degrade the nonfiher tissues to liberate fibers. After dew retting, the stems are mechanically cleaned to remove shive and other contaminants from fibers for use in linen yarns and fabrics. While currently the method of choice, dew retting is restricted to geographical regions with appropriate climates, and the resulting fibers are often inconsistent in quality with significant amounts of dirt and contaminants [21, 25]. Therefore, considerable research has focused on alternative chemical and enzymatic methods to improve the consistency of fiber quality [1, 4, 5, 9, 10, 14, 21, 22, 25]. Increasing U.S. interest in flax fibers for use as cottonized fibers in textiles [4] and for bio-composites [19] globally provides a strong impetus to improve flax retting. The importance of pectin as a binder between cells and the necessity to remove it during retting has been acknowledged for several decades [25]. Therefore, pectinases, and in particular endopolygalacturonases, are effective in retting flax [2, 4, 11, 12, 17, 25, 26]. However, pectin is a complicated polysaccharide that varies in structure [16]. In nonmethylated pectins, often Ca2+ binds carboxyl groups of adjacent molecules, thus stabilizing pectins and thereby plant structure [20]. In flax, recent research has indicated that acidic pectins and Ca2+ are located preferentially in the epidermal regions of flax [18], likely contributing to the structural integrity of the stem and bast fibers. Therefore, complex formers, e.g., chelators, such as ethylenediaminetetraacetic acid (EDTA) to remove Ca2+ have proven useful in retting flax and in facilitating enzyme retting [4, 7, 9, 11, 21].

A bacterial protein called Bt toxin makes a safe and effective pesticide. But Bt-proof bugs could render the agricultural resource useless. So researchers at North Carolina State University are helping to develop a test kit that gives farmers early warning of Bt resistance, allowing them to give the affected area a break from Bt before a “super pest” emerges. Each well holds insect food mixed with an indicator dye that turns bug feces blue. Bt susceptible pests sickened by the toxin dont eat - and therefore dont defecate. But resistant bugs produce blue droppings - a quick, colorful warning for the farmer, who would otherwise have to wait a week or so for the insects to die.
